PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that the record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. Her DD Form 214 indicates that she was discharged under the provisions of Chapter 4, AR 635-200, by reason of expiration term of service with an uncharacterized discharge. Furthermore, the DD Form 214 shows a separation Code of LBK (i.e., expiration term of service).

         b. On 21 November 1989, the applicant was released from active duty. At the time of release, the applicant had 4 months, and 10 days, service on her current period of enlistment under review.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200, in effect at the time set forth the basic authority for separation of enlisted personnel. ARNGUS and USAR soldiers who successfully complete a period of IADT to which ordered will out-process per AR 612-201. The service of soldiers specified in this paragraph who are in entry level status will be uncharacterized, even though they have completed their IADT successfully.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The record shows that on 10 January 1989 the applicant enlisted in the Illinois Army National Guard (ARNG) for a period of 8 years. She completed Active Duty for Training in November 1989 and was properly discharged with a characterization of service of uncharacterized. Any individual who has served for less than l80 days at the time of separation action, and who is not being separated for serious misconduct, will be given an uncharacterized discharge. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. On 9 January 1995 the applicant was honorably discharged from the Illinois ARNG and transferred to the Army Reserve Control Group. On 14 January 1997 the applicant was properly discharged from the Reserve of the Army upon completion of her 8-year contract and issued an Honorable Discharge Certificate. Since a DD Form 214 is only provided for periods of active duty service, the applicant would not have been entitled to receipt of a DD Form 214 upon completion of her Reserve commitment. The Board, being convinced that the characterization of service and the reason for discharge were proper and equitable, voted to deny relief.
